Abstract

This article considers ways in which the implementation of children's rights can be measured in law, policy and practice. It identifies best practice and lessons to be learnt when undertaking the process of auditing the implementation of children's rights. It draws on the author's experience of four different research projects whose task was to measure the extent to which children's rights were being protected and promoted. The article highlights the value of rights‐based research, which attempts to operationalise children's rights by measuring their practical implementation with regard to international standards including the Convention on the Rights of the Child (CRC). It sets out the lessons to be learnt from such research, including how to develop appropriate and effective benchmarks, how to maximise existing standards to this end, and how to apply them in line with the general principles of the CRC.

Abstract

Since the adoption of the United Nations Convention on the Rights of the Child, focus has shifted to its implementation at national level. In this regard, the UN Committee on the Rights of the Child has recommended that every state party needs an independent human rights institution for children which should, whatever its form, be able independently to monitor, promote and protect children’s rights. Ireland established its Ombudsman for Children in 2004, with a founding law that gives the institution a wide range of powers associated with the duty to promote children’s rights. These include the express duty to advise Government, raise awareness, undertake research, and consult with children about matters that concern them. The Ombudsman for Children also has the power to receive complaints from children and investigate actions of public bodies that have adversely affected a child in areas of social and health services, child protection and education. This chapter considers the exercise by the Ombudsman for Children of these statutory powers against the backdrop of international standards on independent institutions for children. It illustrates how the Ombudsman for Children has advanced children’s rights in Ireland by taking a proactive and strategic approach to its legislative mandate, and notes in particular the role that soft power – derived from the Ombudsman’s independence, legitimacy and influence – has helped to maximize the potential of the institution.

Abstract

This article reviews the first volume of the Journal of Children's Services. In doing so, it discusses broader directions and challenges in research, policy and practice. The article focuses on discussion about outcomes, the ‘idea’ of children's services and the impact of interventions on children's health and development. It welcomes reflections on different approaches to outcome measurement, analyses of the practicalities of implementing policy reforms and rigorous evaluations of the impact of Early Years, parenting and other programmes. At the same time, it suggests specific areas in which more work would be valuable, including: socio‐political commentary on policy developments; methods of and results from need analyses; empirical research on inter‐agency initiatives; how to improve the processes and structures that underpin good outcomes; transitions; and understanding ‘what works’ in research dissemination and utilisation. The value of international perspectives (including intra‐UK comparisons) is stressed. Forthcoming special editions on randomised controlled trials (RCTs) (2007) and anti‐social behaviour by young people (2008) will help to address other points raised.
